Welcome to TheGifted Arts. These terms and conditions ("Terms") govern your use of our website, www.thegiftedarts.org, our programs, and our text messaging program. By using our website, enrolling in a program, making a donation, or opting in to receive text messages from us, you agree to these Terms. If you do not agree, please do not use our website or services.
Who we are
TheGifted Arts INC ("TheGifted," "we," "us," or "our") is a 501(c)(3) nonprofit youth arts organization serving young people in Wake County, North Carolina.

What we offer
TheGifted provides arts education programs, workshops, performances, and events for young people, along with related communications for participants, families, volunteers, donors, and community supporters. Our website provides information about these programs and lets you enroll, register for events, donate, subscribe to our newsletter, and contact us.
Text messaging (SMS) terms
Program description. TheGifted Arts offers a text messaging program to keep participants, parents and guardians, volunteers, and supporters informed. Messages may include program enrollment confirmations, class and rehearsal schedules, reminders, schedule changes, event updates, volunteer opportunities, and other information related to our programs and activities.
Consent. By providing your mobile phone number, you agree to receive text messages from TheGifted Arts INC at the number provided, sent using an automated system. Consent is not a condition of purchase, donation, or program enrollment. You must be 18 or older, or the parent or legal guardian of a participant, to opt in on your own behalf.
Message frequency. Message frequency varies depending on your program enrollment and activity. You may receive several messages per week during active program sessions and fewer during breaks.
Message and data rates. Message and data rates may apply. Check with your wireless carrier for details about your plan.
How to opt out. Reply STOP to any message to cancel at any time. After you reply STOP, you will receive one final message confirming that you have been unsubscribed, and you will not receive further text messages from us unless you opt in again.
How to get help. Reply HELP to any message for help. For additional assistance, contact us at contactus@thegiftedarts.org.
Carriers. Carriers are not liable for any delayed or undelivered messages. Delivery of text messages depends on your carrier's network and coverage.
Supported carriers. Our text messaging program is supported by major U.S. carriers. Availability may vary by carrier and device.
Your number. You confirm that you are the account holder for the mobile number you provide, or that you have the account holder's permission to enroll it. If you change or give up your mobile number, please let us know so we can update our records.
Privacy. See our Privacy Policy for how we handle your personal information. Your mobile phone number and text messaging opt-in data and consent will not be shared with or sold to any third parties or affiliates for marketing or promotional purposes.
Program enrollment and participation
Enrollment in TheGifted programs is subject to availability and any program-specific requirements, forms, and consents provided at the time of enrollment. Parents and legal guardians must complete enrollment on behalf of participants under 18. Program-specific agreements, such as participation waivers, media releases, and codes of conduct, are separate from these Terms and apply in addition to them.
Donations
Donations made through our website are voluntary contributions to TheGifted Arts INC, a 501(c)(3) tax-exempt organization. Donations are tax-deductible to the extent allowed by law. We will provide a receipt for your records. Donations are generally non-refundable; if you believe a donation was made in error, contact us and we will work with you to resolve it.
Acceptable use
You agree to use our website and services only for lawful purposes and in a way that does not harm TheGifted, our participants, or others. You may not attempt to gain unauthorized access to our systems, interfere with the operation of our website, or use our services to send unsolicited communications.
Intellectual property
The content on our website, including text, images, logos, videos, curriculum materials, and student work displayed with permission, belongs to TheGifted Arts INC or is used with permission. You may not copy, reproduce, or distribute this content without our written consent, except for personal, non-commercial use.
Disclaimer
Our website and services are provided "as is." While we work to keep our information accurate and our services available, we do not guarantee that the website will be error-free or uninterrupted. To the fullest extent permitted by law, TheGifted Arts INC disclaims all warranties, express or implied, and will not be liable for indirect, incidental, or consequential damages arising from your use of our website or services.
Changes to these terms
We may update these Terms from time to time. When we do, we will post the updated Terms on our website with a new effective date. Your continued use of our website or services after changes are posted means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law principles.
